You expect to have a good day working to earn a living. However, you find yourself in an accident as you run the day’s errand and require urgent medical attention. You call your employer to inform him about your injuries and related losses, but he connects you to his lawyer. Enter workers comp defense lawyer.

A workers’ compensation defense lawyer is your first course of action when you suffer illnesses, injuries and other losses at your workplace. Do all workers need a workers’ compensation lawyer? Is it ever too late to hire a lawyer for your claims? Why do workers’ compensation lawyers do this?  This read will equip you with all the information you need to know about your work environment, safety and insurance compensation.

When to hire a workers’ compensation lawyer

You need to know when to hire a workers’ compensation lawyer to increase your odds of receiving the highest settlement. The following are the prevailing conditions for knocking at your lawyer’s door:

    • Your employer denying your claim

It is common for employers and insurance providers to deny injured employees their rightful compensation. They often do this because they do not expect workers to appeal. However, workers’ compensation attorneys work on a contingency basis. Consequently, they receive their payment after winning your case and receiving your compensation.

    • Your employer insurance provider acts in bad faith

Insurance providers are in business to make money by paying the least amount and retaining the largest portion. The insurance provider sends adjusters to trick you into taking the least compensation. A workers’ compensation lawyer represents you and negotiates to secure you a worthwhile settlement.

    • Your insurer’s settlement is below your medical expenses

Medical expenses take a substantial amount in your compensation. Your employer should ensure all your present and future medical costs cater to sustain you until full recovery. However, most employers give an amount that is insufficient to cater to your surgeries, diagnosis, recovery and rehabilitation. A worker’s compensation attorney calculates your present and future medical expenses and negotiates to secure a sufficient amount for your treatment.

    • Your injuries and complications prevent you from returning to work

An occupational accident can lead to a permanent disability. A partial or total disability can affect your performance and ability to function as you did before the accident.  Consequently, your compensation should cater to your inability to lead a normal life. A seasoned workers’ compensation attorney understands how to calculate your losses and ensures you get full payment.

Your employer retaliates against your filing a claim

Some employers react negatively toward workers upon filing a workers’ compensation claim. You need to hire a workers’ compensation attorney if your employer threatens, demotes, reduces your wage, slashes your hours, or dismisses you from your job. It is your right to seek compensation, and any form of discrimination violates your rights.

    • A third party caused your injuries

A worker can be injured by a machined hired by an employer. An employee could seek compensation if another party other than the employer caused him injuries.  An experienced lawyer understands how to apply the law to secure your payment.

    Common workplace injuries

Workplace injuries differ from one industry to another. Some of the common injuries and accidents include:

    • Slip and falls

Slips, trips and falls are likely to happen in any work environment. You can also fall from a ladder, platforms, and scaffolding can occur anywhere, anytime.

    • Muscle strains

Muscle injuries are also most common in strenuous workplaces. Anyone lifting heavy loads can strain their back and neck muscles. However, you can prevent muscle injuries by using forklifts and proper lifting techniques to protect yourself from repetitive injuries.

    • Injuries from falling objects

Objects can fall on workers as they receive loads for storage or transit. Warehouses encounter more falling objects injury cases than other work environments. However, other workstations such as offices can cause nasty accidents as items fall from cupboards and shelves.  Employers must provide adequate and appropriate storage facilities to enhance safety.

    • Repetitive strain injuries

Repetitive injuries happen when an employee suffers a similar injury on the same body part severally. The cumulative impact on one part can cause severe complications. It is common for people sitting at a computer desk to suffer back, shoulder and neck pains. The repetitive motion of the joints can strain muscles. Employers should provide ergonomic equipment to cushion workers from unnecessary strain. It is also the workers’ responsibility to take short breaks to relax the muscles and encourage full-range body movement.

    • Crashes and collisions

You can be involved in a car crash in your line of duty. Car accidents have nasty consequences and risk suffering fractures, cuts and disabilities. Employees should ensure that all company vehicles have a comprehensive cover and a personal injury cover to cater to a driving employee. Similarly, company cars should have safety belts to secure passengers in case of an accident.

    • Cuts and lacerations

Office implements, farm equipment, factory tools and others can pierce workers as they run their day. Paper trimmers, and power saws, are potential implements that can cause lacerations. Deep cuts can lead to severe bleeding and anemic conditions. Employers should constantly train employees on proper handling practices and provide protective gears to prevent accidents.

    • Inhaling toxic fume

Toxic fumes can cause skin and eye irritation. Working in a processing, construction, or manufacturing plant can expose workers to toxic fumes. Inhaling hazardous fumes can potentially cause suffocation and chest-related complications. The fumes can also trigger asthma, bronchitis and other respiratory conditions. Employees must use protective gear to avoid any dangerous exposure and prevent accidents.

    • Injuries caused by malfunctioning equipment

Machines are essential equipment that makes work easier. However, they can cause accidents when they’re not properly maintained. Employers should ensure that all malfunctioning equipment remains unused. All machines should also be serviced regularly to promote safety.

    Final thought

Work-related injuries can happen anytime, anywhere. Employees should not shy from repowering any accident to their employer when accidents occur. Reach out to a workers’ compensation lawyer if you think you’re getting less than your case deserves.
